Terms of Service

These terms are between you and Two Dice Ltd., 7 Bell Yard, London, WC2A 2JR, United Kingdom. They cover the website, the account portal and the apps.

Who you are dealing with

Morke is operated by Two Dice Ltd., a company registered in England and Wales, at 7 Bell Yard, London, WC2A 2JR, United Kingdom. You can reach us at team@twodice.tech. In these terms, "we" and "us" mean that company, and "you" means the person using Morke.

Agreeing to these terms

By creating an account or using Morke, you agree to these terms. If you do not agree with them, do not use the service. You need to be 18 or older to hold an account.

What Morke is

Morke is a VPN. The apps carry your traffic through one of our exit nodes. This website provides information about the service, an account portal, and, when it is built, a way to pay for a subscription. These terms cover all of it. How we handle data is a separate document: see our Privacy Policy.

Your account and your key

An account is an Account ID and an activation key. There is no email address and no password, so the key is the whole of your credentials. Anyone holding it can use your account, and we have no way to tell them apart from you.

This has a cost. We cannot recover the key, reset it, or verify your identity by any other means, because we hold nothing that would let us. Lose the key and the account is gone, along with any subscription time on it. Keep a copy somewhere you trust. Do not send the key to us, and do not send it to anyone else.

You are responsible for what happens on your account. If you think the key has been exposed, there is currently no way to replace it. Deleting the account stops the key working, and you can do that yourself.

Devices

An account can hold a limited number of active device sessions at once. The limit is shown in the app and in the account portal. Signing in beyond it does not fail: the extra session waits, able to manage sessions but not to connect, and becomes active when a slot frees. You can sign a device out from any of your other devices.

Signing in on this website creates a session of its own. It appears in the app under Active connections, labelled Browser, and it does not count against the limit. That is stated in the Privacy Policy too.

Subscriptions and payment

Morke is sold as a subscription that renews automatically until you cancel it. New subscriptions include a free trial of 3 days. The price is the one shown to you at the time of purchase.

Subscriptions bought in the app are sold and processed by Apple, and Apple's own terms govern that purchase, its renewal, and any refund of it. Cancel it in your Apple Account settings, not with us: we cannot cancel or refund an App Store subscription, because we never took the money.

Paying on this website is not available. Today the App Store is the only way to buy Morke.

Acceptable use

There are things you may not do with a Morke connection, and the list is short and specific. It lives in our Acceptable Use Policy, which forms part of these terms. That page also sets out what we can and cannot see, and what actually happens when someone complains about one of our addresses.

Suspension and termination

We may suspend or terminate an account that breaches these terms or the Acceptable Use Policy. Because a suspension stops the activation key from working, it takes effect on every device at once.

We do not refund the remaining time on an account terminated for a breach. If you think we have made a mistake, email team@twodice.tech and we will look at it again. We will tell you what we decide.

You can stop using Morke at any time. You can delete the account yourself, or ask us to, as described in the Privacy Policy.

What we do and do not promise

We will provide the service with reasonable care and skill, and it will be as described on this site.

We do not promise that it is available without interruption. It runs on a small number of servers rented from other companies, and those companies reboot machines, lose network, and have outages we do not control. Nor can we promise that Morke will work on every network: some networks block VPN traffic, and whether ours gets through on a given network on a given day is not something we can guarantee.

Morke changes what your traffic looks like from outside, and that is all it does. If you sign in to an account somewhere, that service knows who you are, whatever we do.

Our liability, and your legal rights

We are responsible for loss you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss that is not foreseeable, or for business losses: Morke is supplied for personal use.

We do not exclude or limit our liability where the law does not allow us to. That includes liability for death or personal injury caused by our negligence, for fraud, and for anything else that cannot be excluded under United Kingdom law.

If you are a consumer, you have legal rights in relation to services that are not carried out with reasonable care and skill, or are not as described. Nothing in these terms affects those rights. In the United Kingdom, advice about them is available from Citizens Advice.

Changes to the service and to these terms

We may change the service as it develops, including which exit nodes exist and what the apps do. We may change these terms. When we make a change that affects your rights, we will say so on this page and update the date at the top, and if you are on a subscription we will tell you before it takes effect where we can reach you.

If a change is one you do not accept, you can cancel. Cancelling an App Store subscription, and asking Apple for a refund of it, is done in your Apple Account settings.

Governing law

These terms are governed by the law of England and Wales, and the courts of England and Wales have jurisdiction over any dispute.

If you are a consumer living somewhere else, this does not take away the protection of the mandatory consumer law of the country you live in, and you may bring proceedings there.
